By registering, accessing, or using the platform, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our services.

2. Service Description

Our platform allows users to:

• Create personalized digital business cards
• Showcase services, contact information, images, and videos
• Share cards via a QR code or unique URL
• Optionally add advanced features (gallery, video, product sales)

A free basic plan is available. Paid plans unlock additional features.

3. Registration & Account

To access certain features, users must create an account. You agree to provide accurate, complete, and up-to-date information during registration. You are responsible for safeguarding your login credentials.

It is prohibited to:

• Create fake accounts
• Misuse third-party data
• Use the platform for illegal or harmful purposes

4. User Content & Responsibility

Users are solely responsible for the content added to their digital cards, including text, images, videos, and links.

It is strictly forbidden to post:

• Illegal, harmful, misleading, or hateful content
• Content that violates copyrights or third-party rights
• False information or advertisements

We reserve the right to remove inappropriate content without prior notice.

5. Payments & Plans

Both free and paid plans are available. Prices, durations, and features of each plan are listed on the Pricing page. By upgrading, you agree to the listed charges. Payments are securely processed via Stripe (www.stripe.com).

No refunds are issued for completed monthly or annual services unless otherwise stated.

6. Account Cancellation & Deletion

You can cancel your account at any time through your profile or by contacting us at info@verbaspark.com. We may also suspend or delete accounts or content that violate these Terms or applicable laws.

7. Privacy & Data Protection

By using the platform, you agree to the processing of your personal data in accordance with our Privacy Policy. We process data securely and responsibly, in full compliance with GDPR regulations.

8. Provider Rights

The provider reserves the right to:

• Modify or discontinue the service at any time
• Introduce new features or update plan conditions
• Update these Terms (with notice to users)

Important changes will be communicated via email or upon login.

9. Limitation of Liability

You use the platform at your own risk. We do not guarantee uninterrupted or error-free operation, nor can we be held liable for data loss or QR code malfunctions under certain conditions.

We are not liable for any damages arising from the use or inability to use our service.

10. Governing Law & Jurisdiction

This platform is operated by a company registered as a Limited Liability Company (LLC) in the United States. These Terms and all related legal matters are governed by the laws of the state of registration.

As we market and sell services in the European Union, especially in Slovenia, we also comply with EU and local laws on data protection, e-commerce, and consumer rights, including GDPR and national consumer protection laws.

In case of disputes, we will aim to resolve them amicably. If this is not possible, legal jurisdiction lies with courts in the USA unless consumer law in the EU or Slovenia provides otherwise.

11. Product Sales via the “Shop” Module

Our platform allows users to sell their products or services through their digital cards. Secure payments are processed by Stripe, ensuring safe online transactions between buyers and sellers.

Important Notes:

• Payment processing, refunds, shipping, and customer communication are the sole responsibility of the user (seller).
• The platform operator does not participate in any stage of the sales process and is not liable for financial, legal, or consumer issues.
• All payment and user data are processed exclusively via Stripe, which has its own terms and security standards.

Users are responsible for complying with local laws (e.g., invoicing, taxes, consumer rights).

By using the sales feature, you expressly agree to the above and accept full responsibility for all aspects of your business.
